Veticare EducationUpdated October 2026Source: 38 CFR 4.71a

Overview

Intervertebral disc syndrome involves a disc herniation that compresses or irritates a nerve root. The regulation lets VA rate it either by the general spine formula or by incapacitating episodes, whichever gives the higher rating.

How VA rates it

Diagnostic Code 5243 · 38 CFR 4.71a

Here is a plain language summary of the rating levels in the regulation. Read the official text for the exact wording.

RatingSummary of the criteria
60%Incapacitating episodes totaling at least 6 weeks in the past 12 months.
40%At least 4 but less than 6 weeks.
20%At least 2 but less than 4 weeks.
10%At least 1 but less than 2 weeks.

An incapacitating episode means acute symptoms that require bed rest prescribed by a physician and treatment by a physician. The general spine formula levels also apply.

Common secondary connections

These are conditions often discussed in connection with Disc disease and IVDS. A secondary claim generally needs medical evidence that one condition caused or worsened another. This list is general education, not a suggestion about any claim.

  • Radiculopathy
  • Bladder or bowel issues in some cases

Presumptive notes

VA does not list this condition on its main presumptive lists covered in this library. Service connection is generally shown with evidence of a current condition, an in service event, and a link between them. See VA hazardous materials exposure for other presumptive programs.

Evidence veterans generally gather

VA describes evidence types in its evidence guide. For this condition, veterans often collect:

  • MRI showing disc findings
  • Records of physician prescribed bed rest
  • Range of motion measurements
  • A current diagnosis from a medical provider
  • Service treatment records and personnel records
  • VA and private treatment records
  • Statements from you, family, or fellow service members (lay statements)
  • A Disability Benefits Questionnaire (DBQ) completed by a provider, if available
